释义 | 測謊機 An apparatus that measures the physiological reactions in the body, or stress or vibration in the voice, of a person under interrogation, to determine whether the person is telling the truth. The nature of a lie detector ‘polygraph’ test is to detect stress caused by anxiety. The test cannot be conducted in open court. Lie detector results are inadmissible as evidence in a criminal trial, because this is not a recognised area of law and would infringe upon the right of the court to determine certain critical issues, namely guilt or innocence: Bernal & Anor v R (Transcript, 28 April 1997, PC). The admission of lie detector results to bolster the credibility of the accused as a witness offends the well-established rule against adducing evidence solely for the purpose of bolstering a witness’s credibility, as well as the rule against admission of past consistent out-of-court statement: Bernal & Anor v R, supra.
