1. In a strict sense, a contract under which the insurers undertake, in consideration of specified premiums being continuously paid throughout the life of a particular person, to pay a specified sum of money upon the death of that person: Halsbury’s Laws of Hong Kong, Vol 15, Insurance [220,203]; Dalby v India and The London Life Assurance Co (1854) 15 CB 365. 2. In the broader sense, it comprises any contract in which one party agrees to pay a given sum upon the happening of a particular event contingent upon the duration of human life, in consideration of the immediate payment of a smaller sum or certain equivalent periodic payments by another party: Halsbury’s Laws of Hong Kong, Vol 15 Insurance [220,205]. A life insurance policy may be surrendered before maturity to obtain a ‘surrender value’. No contract of life insurance shall be entered into on the life of any person if the person for whose use or benefit or on whose account the contract is to be entered into has no insurable interest: Insurance Companies Ordinance (Cap 41) s 64B(1)(a). The proceeds of a life insurance policy on the life of the deceased are exempted from estate duty: Estate Duty Ordinance (Cap 111) s 10(ga). See also Superannuation.
