Imprisonment for the term of a person’s natural life. The most severe sentence that may be passed. The general criteria for imposing a life term are (1) the offence itself must be grave enough to require a very long sentence; (2) either the nature of the offences or the defendant’s history indicates that he is a person of unstable character likely to commit such offences in the future; (3) if such offences were again committed, the consequences to others would be specially injurious, as in the case of crimes of violence or sexual offences: R v Pang Chun Wai [1993] 1 HKC 233, [1994] 1 HKCLR 137 (CA); Criminal Procedure Ordinance (Cap 221) ss 67B, 67C. The primary consideration is the interests of society: R v Ho Tung Shing & Ors [1994] 2 HKC 404 (CA). Where a judge is considering a sentence of life imprisonment, he should inform counsel of that fact and counsel for the defendant should then be invited to make submissions on that proposed sentence: R v Pang Chun Wai, supra.
