释义 | 承認債項 An admission that there is a debt outstanding and unpaid: Good v Parry [1963] 2 All ER 59, 2 QB 418 (CA). An acknowledgment of debt makes the time run afresh as from the date of the acknowledgment: Limitation Ordinance (Cap 347) s 23(3). The acknowledgment must be in writing and signed by the person making the acknowledgment, or by his agent, and it must be made to the person, or to an agent of the person, whose title or claim is being acknowledged: s 24. No promise to pay is required to be stated: Good v Parry, supra; Busch v Stevens [1962] 1 All ER 412, [1963] 1 QB 1. An acknowledgment of debt does not create a new cause of action but merely renews an existing cause of action: Busch v Stevens, supra. It is effective even if made after the limitation period has expired: s 25(5).
