| 释义 | 進度證 In relation to a building project, a certificate which records the contract administrator’s determination that a specific sum is payable by the proprietor as a progress payment, based on the value of the work performed. A building contract normally requires the proprietor to pay to the contractor the sum certified by the progress certificate. The obligation is enforceable notwithstanding that the work is incomplete: Workman Clark & Co Ltd v Lloyd Brazileno [1908] 1 KB 968. Although the valuation should include an allowance for defective work, its omission does not constitute acceptance of the work and materials previously provided: Construction Services Civil Pty Ltd v J & N Allen Enterprises Pty Ltd (1985) 1 BCL 363; 5 Aust Const LR (Pt 2) 14. In general, a progress certificate creates a debt in favour of the contractor which the employer must pay at once but subject to the terms of their agreement (Peter Leung Construction Co Ltd v Tai Poon Co Ltd [1985] 1 HKC 285 (CA)) as well as any set-off (Young’s Engineering Co Ltd v Hang Sing Construction Co Ltd (HCA 460/84, unreported)). Such a certificate is not normally binding upon the parties as to quality or amount and are subject to adjustment on completion: Lamprell v Billericay Union [1849] 3 Exch 283. It is considered to have ‘provisional validity’: Beaufort Developments (NI) Ltd v Gilbert-Ash (NI) Ltd [1999] 1 AC 266 (HL). Also known as ‘interim certificate’.
