释义 | 承諾 In contract law, to undertake responsibility for a state of affairs or the occurrence of an event. A term that expresses an undertaking as to an event or as to the truth of a present or past fact embodies a promise, the breach of which gives rise to a claim for damages. Such a term may be distinguished from a contractual term that qualifies a party’s obligation by merely providing for a contingency, which does not express a promise and therefore for which damages are unavailable if the contingency is unfulfilled. A promise may be made by deed or in writing, or orally, or partly in writing and partly orally: J Evans & Son (Portsmouth) Ltd v Andrea Merzario Ltd [1976] 2 All ER 930, 1 WLR 1078 (CA).
