| 释义 | 貧困的 Poor or destitute. A trial for an offence would normally be unfair or miscarriage of justice where an indigent accused is unrepresented through no fault of his or her own: R v Yeung Kin Man (CACC 337/85, unreported); R v Yim Yau-hay [1988] HKC 847. A person charged with a criminal offence is entitled to have legal assistance assigned to him in any case where the interests of justice so require, and without payment by him in any such case if he does not have sufficient means to pay for it: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 11(2)(d); International Covenant on Civil and Political Rights (ICCPR) art14(3)(d). The court may grant an adjournment in such circumstances: Criminal Procedure Ordinance (Cap 221) s23(4). The fact that an accused, who had earlier declined legal aid, was unrepresented at trial, is no denial of justice: R v Lam Chi Wai [1986] HKC 240.
