释义 | 不可由法院作出判決 A matter that cannot be determined or reviewed by a domestic court. For example, when considering matters of international relations such as the extent of foreign territory or the existence of a state of war, a ministerial certificate on the matter is conclusive proof of the matter in court, and is not open to judicial review or consideration. Non-justiciable questions of fact concern acts of state such as defence and foreign affairs (matters in respect of which a certificate of the Chief Executive would be binding on the courts): Basic Law art 19. This expression is also used in the context of the supervisory jurisdiction of the courts in judicial review in denoting questions that the courts would have no jurisdiction to review or declare: Jackson v A-G [1980] 1 HKC 182 (CA); A-G v Moy Chung Man John [1981] 1 HKC 190 (HC); Ngo Kee Construction Co Ltd v Hong Kong Housing Authority [2001] 1 HKC 493.
