Equitable damages are awarded by a court of equity within equity’s concurrent and auxiliary jurisdictions, confirmed and widened since (UK) Lord Cairns’ Act 1858. Equitable damages may be awarded either in addition to or substitution for an injunction or decree of specific performance. Equitable damages, no less than common law damages, involve the exercise of a judicial discretion: Kishimoto Sangyo Co Ltd & Anor v OBA & Ors [1996] 2 HKC 260 (CA).
