| 释义 | 具有資格 In relation to evidence, a witnesses’ capacity or capability to testify in a legal proceedings. Persons of unsound mind shall be incompetent to give evidence in any proceeding: Evidence Ordinance (Cap 8) s 3. A child witness is to be regarded as competent unless the contrary is shown: R v Lam Chi Keung [1997] 2 HKC 250, HKLRD 421 (CA). The evidence of persons who had been convicted of crimes are competent to give evidence: s 9. A person who was not a party to the case but with an interest in the case is competent to give evidence: s 9. The accused is competent only as a witness for the defence: Criminal Procedure Ordinance (Cap 221) s 54(1). An accomplice is a competent witness : R v Turner [1975] 61 Cr App Rep 67; R v Chu Kwan Kong [1977] HKLR 371. If an accomplice is jointly charged in the same indictment in the same proceedings with the accused against whom he proposes to testify, he is not competent as a witness for the prosecution: R v Grant [1944] 2 All ER 311; R v Shorrock [1947] 32 Cr App Rep 124; Criminal Procedure Ordinance (Cap 221) s 54. Sovereigns, heads of state of independent nations and persons under diplomatic or consular immunity are competent but not compellable as witnesses: R v Nowaz [1976] 3 All ER 5, 1 WLR 830.
