释义 | 強制退休 As a result of disciplinary proceedings or attaining the age so specified in the employment contract or the statute, an employee is forced to retire or leave the employment or office: Ratcliffe v Secretary for Civil Service [1999] 4 HKC 237; Pang Tak Kwai v Cmr of Correctional Services [2000] 4 HKC 574. The normal age of retirement of an officer, other than a judge or a district judge, holding an established office shall be on attaining the age of 55 years: Pensions Ordinance (Cap 89) s 8. An inspector who is found guilty of or pleads guilty to a disciplinary offence may be punished by the imposition of compulsory retirement: Customs and Excise Service (Discipline) Rules r 15(b)(iii); Prison Rules (Cap 234A) r 254. Any inspector, non-commissioned officer or constable may be required to retire from the Hong Kong Auxiliary Police Force if it appears to the Commissioner of the Force that such member is unable to discharge efficiently the duties which he is or may be called upon to perform as a member: Hong Kong Auxiliary Police Force Ordinance (Cap 233) s 9.
