A condition evidencing deterioration in, or loss of, the intellectual faculties, which is commonly attended by confusion and disorientation reflecting loss of memory by reason of arteriosclerotic degeneration. Dementia arising from advanced age or produced by alcoholism or any other causes may destroy testamentary power: Re Heinke, Westminster Bank Ltd v Massey (The Times, 21 January 1959, unreported). The fact that the accused is suffering from dementia does not, of itself, render the accused unfit to be tried: R v Chiu Te Ken Deacon [1993] 3 HKPLR 483, 2 HKCLR 21. Also known as ‘senile dementia’ or ‘mental infirmity’. See also Disability; Mental infirmity.
