释义 | 剝奪司法管轄權 The removal of the ability of a court of competent jurisdiction to review or pass judgment on a particular issue or instrument. An agreement purporting to oust the jurisdiction of the courts entirely is illegal and void on grounds of public policy: Lee v Showmen’s Guild of Great Britain [1952] 2 QB 329 (CA). However, a properly drafted legislative provision may do so: Anisminic Ltd v Foreign Compensation Commission [1969] 2 AC 147 (HL); Chan Yik Tung v Hong Kong Housing Authority [1989] 2 HKC 394 (HC). An objection to the jurisdiction of one of the superior courts of general jurisdiction must show what other court has jurisdiction, so as to make it clear that the exercise by the superior court of its jurisdiction is unnecessary: Mostyn v Fabrigas (1775) Cowp 161, Ex Ch; Ngan Chor Ying v Year Trend Development Ltd [1995] 1 HKC 605 (HC).
