That which remains undischarged or unpaid, such as an outstanding debt. A legal estate in land is said to be outstanding when the vendor holds a beneficial title to the land but the legal title is vested in another person, such as a trustee. The purchaser may require the vendor to ‘get in’ the outstanding legal estate by obtaining a conveyance of it from such a trustee or mortgagee. With respect to land subject to a general law mortgage it is possible for the purchaser to waive the right to require that the vendor get in the outstanding legal estate: Re Williams and Parry’s Contract (1859) 72 LT 869.
