释义 | 軍事法 A body of rules and regulations formulated within a national legal system for the governance and discipline of armed forces and persons employed in the military service of a state. The Hong Kong SAR does not have armed forces of its own as its defence is conducted by the Central People’s Government of the PRC: the Basic Law art 14 para 1. Hence, the Hong Kong SAR does not have its own separate law and practice governing military forces. Members of the Chinese garrison stationed in Hong Kong by the Chinese Central People’s Government are subject to the military law of the PRC: for example the Garrison Law of the People’s Republic of China 1996. Military law differs from martial law in that the former applies to armed personnel only, to the absolute exclusion of civilians, and does not necessarily supersede civil law.
