In criminal law, an inability to attempt or conspire to commit a crime because the thing attempted or the object of the conspiracy would not in law amount to a criminal offence if carried out to completion. In such a situation the attempt or conspiracy would not itself amount to a criminal offence: DPP v Nock [1978] AC 979, 2 All ER 654 (HL); HKSAR v Saifudeen Abdul Wahid [1997] 3 HKC 729 (CA). The impossibility at common law is very narrow and is confined to crimes which are legally or physically impossible to commit: R v Bennett (1978) 68 Cr App Rep 168 (CA).
