One promises not to enforce his or her claim against others. A promise to forbear takes various forms; it may be absolute or for a limited period of time and sometimes time is not specified at all. In case no time is specified by the promisor when making the promise, the promise to forbear is to be understood for a reasonable period of time: Fullerton v Provincial Bank of Ireland [1903] AC 309 (HC). In addition, a forbearance to sue could be implied or expressed: Thomas Lo Contracting Ltd v William Strathearn Dock (HCA 10205/2000, unreported). Forbearance to sue amounts to good consideration for a simple contract: Bills of Exchange Ordinance (Cap 19) s 27; Fortune Focus International Ltd v The (Holdings) Co Ltd [1998] 1 HKLRD 304 (CA).
