释义	相互錯誤 A situation where both parties to a contract are mistaken, but each party makes a mistake different from the other. Mutual mistake may arise where there has been no meeting of the minds, since the parties intend different things. In this case, no contract is concluded: Beesley v Hallwood Estates [1960] 2 All ER 314, [1960] 1 WLR 549. However, mutual mistake in the expression of a transaction allows the remedy of rectification: Riverlate Properties Ltd v Paul [1974] 2 All ER 656, [1975] Ch 133 (CA).
