释义 | 相互信貸 Transactions between persons giving rise to debts owed by one to the other. Mutual credits are able to be set off where one of the parties becomes bankrupt: Bankruptcy Ordinance (Cap 6) s 35. To be mutual, each transaction must be entered into in the same capacity and not, for example, in the first case as a trustee and in the second in the person’s own right. See also Bankrupt; Set-off. 指人們之間的交易引致一方欠另一方債項的情形。當一方破產時,相互信貸可作出抵銷:《破產條例》(第6章)第35條。要成為相互信貸,每一宗交易均須以相同的行為能力作出而非,舉例,第一宗為信託人,而第二宗則為以該人士本身。另見 Bankrupt; Set-off。 |
