| 释义 | 憑貨品說明的售賣 A contract in which goods are sold or supplied according to a description. The buyer enters into the contract of sale in reliance on the description of the goods given by or on behalf of the seller: Christopher Hill Ltd v Ashington Piggeries Ltd [1969] 3 All ER 1496 (CA). In such a contract, it is implied that the goods correspond with the description: Sale of Goods Ordinance (Cap 26) s 15(1). ‘Description’ usually means a particular class or kind of goods, but it also includes any statement which constitutes a substantial ingredient of the identity of the thing sold: Reardon Smith Line Ltd v Hansen-Tangen [1976] 3 All ER 570, 1 WLR 989 (HL). The course of dealing between the parties may show the meaning of the terms used and so may establish a sale by description: Bostock & Co Ltd v Nicholson & Sons Ltd [1904] 1 KB 725. If the sale is by reference to a sample as well as by description, the bulk of the goods must correspond with both the sample and the description: s 15(1).
