In criminal law, information, statements, or facts of which a party has not adduced in trial. Fresh evidence may be admitted on appeal: Criminal Procedure Ordinance (Cap 221) s 83V. The Court of Appeal would only admit the fresh evidence, if (a) it appears to it that the evidence is likely to be credible and would have been admissible in the proceedings; and (b) it is satisfied that it was not adduced in those proceedings but there is a reasonable explanation for the failure to adduce it: Criminal Procedure Ordinance (Cap 221) s 83V(2). Fresh evidence is admissible at the hearing of such an appeal at the judge’s discretion where he thinks additional evidence is necessary: Magistrates Ordinance (Cap 227) s 118(1)(b).
