释义 | 提供合約承諾的履行 The offer of performance made by the promisor to the promisee. The promisor must tender the performance within the time required by the contract. Where a promise cannot be performed without the concurrence of the promisee (as in the case of a contract to deliver goods), the promisor is freed from liability for non-performance of the contract if he makes an unconditional tender or offer of performance in accordance with the terms of his promise and the promisee refuses to accept performance, provided that the tender is made under such circumstances that the other party has a reasonable opportunity of examining the performance tendered in order to ascertain that it conforms to the contract (Sale of Goods Ordinance (Cap 26) s 36). In the case of a tender of money, the tender must be a legal tender ie the money is actually produced: Farquharson v Pearl Assurance Co Ltd [1937] 3 All ER 124.
