| 释义 | 資料及所信之事誓章 An affidavit sworn for the purpose of being used in interlocutory proceedings: The Rules of the High Court (Cap 4A) O 14 rr 2(2), 4(2), O 38 r 3, 41 r 5(1), O 86 r 2(1). It is used under circumstances where it is not reasonably practicable to call oral evidence, or where to call a witness would cause undue expense or delay. An affidavit that includes evidence based on knowledge, information, or belief must set out the sources and grounds of the knowledge or information or the basis of the belief: O 41 r 5(2). See also Affidavit. 藉宣誓作出而使其能用於非正審法律程序的誓章：《高等法院規則》（第4A章）第14號命令第2(2)、4(2)條規則；第41號命令第5(1)條規則；第38號命令第3條規則；第86號命令第2(1)條規則。當傳召他人提供口頭證據在合理情況下並不可行，或傳召作證人會引起不當開支或延誤，便會使用資料及所信之事誓章。誓章若包含以所知之事、資料或所信之事為依據的證據，則該誓章必須羅列所知之事或資料的來源及理由依據，或所信之事的根據：第41號命令第5(2)條規則。另見 Affidavit。 |
