释义 | 空中侵權行為 A tort (civil wrong) committed on board an aircraft, which is governed by the rules of private international law and by various international conventions on air navigation and air carriage, etc. As a general principle therefore, the law of Hong Kong would be applicable if the incident occurs when the aircraft is standing at Hong Kong International Airport or over the airspace of Hong Kong. If incidents occur over Hong Kong’s airspace for aircraft registered outside Hong Kong, then the Director of Aviation may authorise a duly competent authority in that country to carry out an investigation into the matter in Hong Kong: Hong Kong Civil Aviation (Investigation of Accidents) Regulations (Cap 448B) reg 20(1). The international conventions referred to include, inter alia, the Warsaw, Chicago and Montreal Conventions and contracting states each have complete and exclusive sovereignty over their own airspace.
