释义 | 最終爭論點規則 The rule that a witness may not be asked a question involving the application of facts or opinion to a legal standard which the court itself is to decide. At common law opinion evidence could not be given, even where it fell within an exception, if it dealt with the ultimate issue to be decided by the court. The rule has been repealed for civil cases: Evidence Ordinance (Cap 8) s 58. However, it appears still to apply to criminal cases as where a medical witness can only testify meaningfully on the issue of insanity by dealing directly with ultimate issues: R v Chan Man Shing [1989] 2 HKC 186 (CA). Whether the court requires the assistance of an expert upon ‘the ultimate question’ depends on the facts of the case; upon the expertise, whether that expertise is relevant to the ultimate question; whether the expert’s opinion on ‘the ultimate question’ is a conclusion which depends upon his expertise or is proffered in some other capacity: HKSAR v Mo Sze Lung Thomson [2003] 2 HKC 356 (CA).
