| 释义 | 公共法律責任保險 An insurance which protects the insured against the risk of incurring legal liability, usually tortious, to third parties. It is an indemnity, usually with a pecuniary maximum as regards any one accident or as regards liability during any one period of insurance, against legal liability to members of the general public, as distinct from persons in the service of the assured or as distinct from such persons as members of the assured’s family or household. Public liability policies usually exclude liability for bodily injury sustained by employees or arising out of the use of vehicles, ship or aircraft or arising out of food or drink poisoning and liability voluntarily assumed by contract. It normally contains restrictions of liability by reference to the type of business carried on by the assured: Wayne Tank and Pump Co Ltd v Employers’ Liability Assurance Corp Ltd [1974] QB 57, [1973] 3 All ER 825 (CA).
