| 释义 | 公職 Any office or employment the holding or discharging of which by a person would constitute that person a public officer: Interpretation and General Clauses Ordinance (Cap 1) s 3. The expression has been understood as having a wide application: R v Whitaker [1914] 3 KB 1283 (CCA); R v Bowden [1995] 4 All ER 505. The holder of a public office owes duties (statutory or common law) to members of the public as to the manner in which those powers are exercised. An action for misconduct in public office may arise where a public official, in the course of or in relation to his public office, wilfully and intentionally, culpably misconducts himself and the misconduct is serious: Shum Kwok Sher v HKSAR [2002] 3 HKC 117.
