释义 | 兩名證人的規則 The rule that an accused may only be convicted on the credible testimony of two or more witnesses. A person is not liable to be convicted of perjury solely upon the evidence of one witness as to the falsity of any statement alleged to be false: Crimes Ordinance (Cap 200) s 43. Therefore, a successful prosecution for perjury or subornation of perjury requires the evidence of more than one witness as to the falsity of a perjurer’s statement alleged to be false. There must be either the evidence of two witnesses or the evidence of one witness corroborated by some material fact. It is not necessary to have two witnesses as to the falsity of the appellant’s statement before the judge, all that is required is one witness who is corroborated by either another witness or documents: R v Lui Kwok Wai [1991] 2 HKC 149. No corroboration is required at all in the case where all the facts are admitted: R v Sabnini [1991] 1 HKC 579. See also Corroboration; Corroboration warning; Perjury. |
