The exercise of the right provided in the Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 16(2) carries with it special duties and responsibilities. It may, therefore, be subject to certain restrictions, but shall only be, for respect of the rights or reputations of others; for the protection of national security or of public order, or public health or morals. In Hong Kong, freedom of expression is guaranteed under the Basic Law and Hong Kong Bills of Rights Ordinance. Freedom of expression includes freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in form of art, or through any media of the person’s choice as also stated in International Covenant on Civil and Political Rights. However, the exercise of the freedom of expression is not without restrictions. The right, which may be subject to restrictions, also caries with it special duties. For example, to respect of the rights or reputation of others, for the protection of national security, public order, public health and public morals: Universal Declaration on Human Rights art 19; International Covenant on Civil and Political Rights art 19(2), Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 16, Basic Law arts 27, 29; Ming Pao Newspapers Ltd & Ors v A-G [1996] 6 HKPLR 103 (PC).
