| 释义 | 有條件應訴書 An appearance reserving the right to apply to the court to set aside the originating process or service for the lack of jurisdiction or an alleged irregularity. The appearance becomes unconditional if the defendant fails to take steps to set aside the originating process. The modern practice is to allow a defendant to make application to set aside originating process without entering an appearance: The Rules of the High Court (Cap 4A) O 12 rr 7, 8. Also known as ‘appearance under protest’.
