Assignment clause |
A clause in an agreement which permits a party to the agreement to assign the interest of that party to some other person. For example, in a marine insurance contract, such a clause would authorise the transfer of the insurance interest to another by indorsement on the policy. However, where the assured assigns or otherwise parts with his interest in the subject-matter insured, he does not thereby transfer to the assignee his rights under the contract of insurance, unless there be an express or implied agreement with the assignee to that effect: Marine Insurance Ordinance (Cap 329) s 15. See also Assignment; Indorsement; Marine insurance policy. |
