| 释义 | 訴訟因由的合併 A plaintiff is entitled in one action to join more than one cause of action against the same defendant either without leave of the court or, where he is not so entitled, with such leave: Halsbury’s Laws of Hong Kong, Vol 5(1), 2000 Reissue, Civil Procedure [90.0280]. The general rule is that causes of action may be joined in this way if the plaintiff claims, and the defendant is alleged to be liable, in the same capacity in respect of all of the causes of action: The Rules of the High Court (Cap 4A) O 15 r 1. In this case, no leave would be required from the court. Where leave is required from the court, application is made ex parte by affidavit made before the issue of the writ or originating summons and stating the grounds of the application: Halsbury’s Laws of Hong Kong, Vol 5(1), 2000 Reissue, Civil Procedure [90.0281]. There is no requirement similar to the one in the Rules of the High Court (Cap 4A) O 15 r 4 (joinder of parties) that there be some common question of law or fact in the various causes of action. It is subject, however, to the Rules of the High Court (Cap 4A) O 15 r 5, which gives the court the discretion to order separate trials if that appears to be the most convenient and efficient way of proceeding: Cameron & Kelly Principles and Practice of Civil Procedure in Hong Kong (2001) ch 3 p 37.
