释义 | 無條件的應訴書 An appearance by a party to a proceeding that indicates that the party submits to the jurisdiction of the court. This means that the person who files an appearance waives any objection to the court hearing and determining the matter. Once the jurisdiction of the court has been ousted, a defendant does not submit to the jurisdiction even by entering unconditional appearance: Wilkinson v Barking Corp [1948] 1 KB 721. An unconditional appearance will also operate as a waiver of any irregularity in the originating process: The Rules of the High Court (Cap 4A) O 2 r 2; I Congreso Del Partido [1978] QB 500. For the purposes of determining whether a judgment given by a court of an overseas country should be recognised or enforced in Hong Kong, the person against whom the judgment was given shall not be treated as having submitted to the jurisdiction of the court by reason only of the fact that he appeared (conditionally or otherwise) in the proceedings for any of the following purposes: to contest the jurisdiction of the court; to ask the court to dismiss or stay the proceedings on the ground that the dispute in question should be submitted to arbitration or to the determination of the courts of another country; to protect, or obtain the release of, property seized or threatened with seizure in the proceedings: Foreign Judgments (Restriction on Recognition and Enforcement) Ordinance (Cap 46) s 4.
