| 释义 | 促致、獲取 To produce by endeavour in the sense that the accused sets out to see that a thing happens and takes steps to produce that outcome: R v Broadfoot [1977] 3 All ER 753, 64 Cr App Rep 71 (CA). A person who procures the commission of an offence by any other person is guilty of that offence and is liable to be tried and punished as a principal offender: Criminal Procedure Ordinance (Cap 221) s 89; R v Wong Hoi [1966] HKLR 386. The word ‘procure’ is used in their ordinary meaning and are not terms of art: A-G’s Reference (No 1 of 1975) [1975] QB 773, 2 All ER 684 (CA). Where it is alleged that the accused procured the offence, the prosecution must prove a causal connection between the act constituting the procurement and the crime although it is not necessary to establish that the offence was committed in the manner it was procured: R v Szeto Kwok Hei [1991] 2 HKLR 178 (CA).
