An acceptance is qualified when it is conditional (which makes payment by the acceptor dependent on the fulfilment of a condition therein stated); partial (an acceptance to pay part only of the amount for which the bill is drawn); local (an acceptance to pay only at a particular specified place; an acceptance to pay at a particular place is a general acceptance, unless it expressly states that the bill is to be paid there only and not elsewhere); qualified as to time; the acceptance of some one or more of the drawees, but not of all: Bills of Exchange Ordinance (Cap 19) s 19(3). A qualified acceptance in express terms varies the effect of the bill as drawn: s 19(2). An acceptor who wishes to qualify the acceptance must do so in definite terms on the face of the bill, so that anyone taking the bill may clearly understand that it was accepted subject to an express qualification: Meyer & Co v Decroix Verley et Cie [1891] AC 520 (HL). A holder of a bill may refuse to take a qualified acceptance and, if he does not obtain a unqualified acceptance, may treat the bill as dishonoured by non-acceptance: s 44(1).
