Wigs and gowns worn by barristers and some members of the judiciary in court. Senior counsel wear silk gowns and long wigs. Robes are only worn at certain times depending on: the court; the type of business that is being conducted before the court; and, the practice of the court. As a general rule, barristers are required when appearing in open court to wear robes: R v Whittaker (1844) 8 JP Jo 390. An exception is where a barrister appears on his own behalf. The court may dispense with them where there is good reason: St Edmundsbury and Ipswich Diocesan Board of Finance v Clark (No 2), 3 All ER 903. The general principle otherwise is that robes are not worn before a tribunal which is not itself robed. Robes are not worn in a magistrate’s court, a coroner’s court or before a disciplinary inquiry. Notes for guidance on dress in court have been issued by the Bar Council with the concurrence of the Chief Judge: The Bar of Hong Kong Code of Conduct para 140 and Annex 11. See also Barrister; Wig.
