释义 | 法定式按揭 A mortgage of land valid at law and in equity. A legal mortgage of land or an interest in land must be expressed to be a charge by deed: Conveyancing and Property Ordinance (Cap 219) s 44(1). A legal charge does not vest any estate in the mortgagee, but creates a legal interest which confers on the mortgagee the same protection, powers and remedies as a mortgage by demise: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0639]. The mortgagee’s interest is an encumbrance over the land, which carries a number of rights over the property that may be exercised should the mortgagor fail to repay the loan in accordance with the agreed terms. The rights of the mortgagee are therefore not just personal against the mortgagor but are proprietary in the sense that the mortgagee may look to the property for repayment of the loans regardless of the issue of whose hands the property may come into: Nield, Hong Kong Land Law (2nd Ed, Longman) ch 17 p 443.
