释义 | 上訴 1. In the narrow sense an application to a higher court to reconsider or rehear the decision of a lower court, on the ground that there has been an error in the decision of the lower court, available on a question of law only or for mistakes of fact or law. An appeal may be as of right, or may depend on the higher court consenting to the appeal (usually by way of granting leave to appeal). The higher court may dismiss the appeal by affirming the decision of the lower court, or reversing or modifying the decision of the lower court, or remitting the matter to the lower court for reconsideration in the light of principles set out by the higher court. A right of appeal may be created, limited or abolished by statute. The Court of Final Appeal has been the highest court of appeal in Hong Kong since 1 July 1997, when appeals to the Privy Council in the United Kingdom ceased by virtue of the termination of sovereignty of the United Kingdom over Hong Kong. 2. More broadly, includes an appeal by way of re-hearing. An appeal includes an application in relation to a case in which a decision has been made to a court higher in the judicial hierarchy for a new trial, or to set aside a verdict, finding or judgment that has been tried, or in which any issue has been tried, by a jury: High Court Ordinance (Cap 4) s 2. 3. An appeal from an executive authority to another executive authority or to a court: Ex p Australian Sporting Club Ltd, Re Dash (1947) 47 SR (NSW) 283. Such an appeal process may in truth be an originating application rather than an appeal stricto sensu: Cmr of Inland Revenue v Board of Review ex p Herald International Ltd [1964] HKLR 224; Chan Kit v Sam Wo Industrial Manufactory [1989] 1 HKC 115 (CA); Bird v English Schools Foundation & Anor [1997] 2 HKC 294 (HC).
