释义 | 法定產業權 An estate in land which is recognized and enforceable both at common law and in equity. In Hong Kong, it is the interest in the land held by a Government lessee in the case of land alienated by Government lease, and in the case of a sub-lease granted by that lessee, for a term less than that of the Government lease: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0005]; Chan Koon Wah v Young Tak Lor [2001] 3 HKLRD 361 (DC); Lau Kwok Cheong & Anor v Tse Ming Chiu [2001] 3 HKC 196, 2 HKLRD 500 (CFI). Legal estate has been defined to mean a term of years absolute in land; the legal interest in any easement, right, privilege in or over land for an interest equivalent to a term of years absolute; and a legal charge: Conveyancing and Property Ordinance (Cap 219) s 2. The terms ‘legal estate’ and ‘legal interest’ are used interchangeably to denote the interest of the Government lessee and that of the sub-lessee.
