| 释义 | 法人 An entity on which a legal system confers rights and imposes duties. A legal person includes a natural person, and an artificial or statutory body such as a company, or partnership (Sutton’s Hospital Case [1558-1774] All ER Rep 11). It may also include an unborn child for specific purposes. In a loose sense a legal personal representative is, owing to his fiduciary duties, a trustee for the creditors and beneficiaries claiming under the deceased while he is acting as personal representative and before he has completed his functions as such and become a trustee in the strict sense: Stamp Duties Cmr (Queensland) v Livingston [1965] AC 694, [1964] 3 All ER 692 (PC).
