释义 | 法定權益 The legal, as opposed to beneficial, interest in property. Under the system of common law and equity, the legal title in property can be separated from its beneficial interest. A legal interest is a right in rem (ie, it is enforceable against anyone), while an equitable interest confers only a right in personam. In Hong Kong, the term ‘legal estate’ and ‘legal interest’ are often used interchangeably to denote the interest of the Government lessee and that of the sub-lessee. See also Legal estate. 法定,與實益相對,乃指財產權益。根據普通法與衡平法體系,財產的法定所有權可與實益權益分開。法定權益指對物的權利(即是可針對任何人強制執行),而衡平法上的權益是對人賦予的權利。在香港,“法律產業權”與“法定權益”通常可交替使用,以表明政府土地承租人及分租承租人的權益。另見 Legal estate。 |
