释义 | 相當可能欺騙或混淆 In trademark law, likely to mislead others. It shall not be lawful to register as a trade mark or part of a trade mark any matter the use of which would be likely to deceive or would disentitle protection in a court of justice or would be contrary to law or morality, or is a scandalous design: Trade Marks Ordinance (Cap 43) s 12(1). The test of likely to deceive was that whether there will be a reasonable likelihood of deception or confusion among a substantial number of persons: Re Gay Giano Trade Mark [1996] 2 HKC 646 (HC). When two trademarks are deceptively similar and bear visual resemblance as a whole, not as to a part, or parts thereof, then there is reasonable likelihood of confusion: Montres Tudor Sa v Concord Watch Co Sa (No 1) [2001] 3 HKC 349 (CFI).
