释义 | 旅費 The fare paid by a passenger for carriage by sea from one place to another. Passage money is within the meaning of freight under the Merchant Shipping (Collision Damage Liability and Salvage) Ordinance (Cap 508) s 2(1). It is the equivalent of freight in a contract of carriage of goods and must be paid as and when agreed. The master of a vessel may exercise a lien over the passenger’s luggage for the unpaid passage money, but not on his person or on the clothes he is wearing: Wolf v Summers (1811) 2 Camp 631. If the contract of carriage is not one requiring the entire obligation to be performed, passage money will not be recoverable if the ship is lost after the voyage commences. Passage money, namely money paid by the passenger before sailing, is not, however, covered by a policy on freight unless the terms of the particular policy necessitate a different construction: Marine Insurance Ordinance (Cap 329) s 90, sch r 16.
