释义 | 非自願行為 An act or omission occurring independently of the exercise of a person’s will, without any awareness of the act, or without any rational control over his actions. A person is not criminally liable for involuntary conduct, owing to a defect of reason arising from a disease of the mind within the M’Naghten Rules: Bratty v A-G for Northern Ireland [1961] 3 All ER 523, [1963] AC 386 (HL). For example, no criminal liability is attracted by acts performed while sleepwalking: Bratty v A-G for Northern Ireland, supra. It is for the prosecution to negative the defence beyond reasonable doubt: R v Chan Tak Kwong [1997] 1 HKC 478 (HC); R v Fung Mui Lee [1996] 1 HKC 72 (CA).
