释义 | 不可抗拒的衝動 An involuntary inclination to act, due to mental illness, which prevents a person from being able to control his or her actions, even though the person may know and appreciate that doing the act is wrong or unlawful. Irresistible impulse is not, of itself, a defence: A-G (SA) v Brown [1960] AC 432, 1 All ER 734. However, evidence of an irresistible impulse may be relevant in deciding whether a disease of the mind was present if there is medical evidence that it is a symptom of a particular disease of the mind: A-G (SA) v Brown, supra. Also known as ‘uncontrollable impulse’.
