In contract of option, the grantor of the option offers to enter into what may be called a ‘major’ contract with the option-holder and makes a separate contract to keep his or her offer open. An option is no more than an offer, which, if given for consideration or contained in a deed, may be irrevocable but in any case remains open for acceptance until it is revoked: Stromdale & Ball Ltd v Burden [1952] 1 Ch 223; 1 All ER 59. With regard to the envisaged major contract, the effect of the contract of option is to create an irrevocable offer and a power of acceptance. The offer is irrevocable in a sense that it is a breach of the contract of option to revoke it: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.035]. However, the expression is subject to criticism: Varty (Inspector of Taxes) v British South Africa Co [1964] 2 All ER 975, [1965] Ch 508 (CA).
