Criminal law - It is unlawful to have homosexual buggery with a male under the age of 21 years: for example, Crimes Ordinance (Cap 200) s118C. Evidence of an accused’s homosexuality may be relevant and admissible to a charge of an act of indecency on boys: Thompson v R [1918] AC 221. Homosexual offences are not to be treated as forming some separate category distinct from other offences and calling for the application of special rules: DPP v Boardman [1974] 3 All ER 887, [1975] AC 421 (HL). Family law - In proceedings concerning children, a person’s homosexuality of itself does not preclude the person from gaining a parenting order for residence or contact with a child. However, it is a matter which the court will take into consideration if it is shown that the parent’s homosexuality impacts in some way on the child. Some judges have expressed concern about the possible disadvantage to children placed with an openly homosexual parent: In the Marriage of L [1983] FLC 91-353. The sexual orientation of a parent is only one of the factors to be taken into account: In the Marriage of Doyle (1992) 15 Fam LR 274.
