| 释义 | 聲音紀錄 The aggregate of sounds emboded in a record. A recording of sounds, from which the sounds may be reproduced, or a recording of the whole or any part of a literary, dramatic or musical work, from which sounds reproducing the work or part may be produced, regardless of the medium on which the recording is made or the method by which the sounds are reproduced or produced: Copyright Ordinance (Cap 528) s 6(1). Copyright subsists in sound recordings: s 2(1). However, copyright does not subsist in a sound recording which is, or to the extent that it is, a copy taken from a previous sound recording: s 6(2). The author of a sound recording is the producer: s 11 (2)(a). Copyright in a sound recording expires at the end of the period of 50 years from the end of the calendar year in which it is made; or if during that period it is released, 50 years from the end of the calendar year in which it is released, subject as follows. A sound recording is ‘released’ when it is first published, played in public, broadcast or included in a cable programme service; but in determining whether a sound recording has been released no account is to be taken of any unauthorized act: s 18(2), (3). The copyright owner of a sound recording has the exclusive right to copy it (s 23), issue copies to the public (s 24), renting copies to the public (s 25), making available copies to the public (s 26), playing or showing the sound recording in public (s 27(3)), broadcasting the sound recording or including it in a cable programme service (s 28(b)).
