释义 | 受託人的委任 The appointment of a person to act as a trustee by the settlor or pursuant to a power granted by the settlor (expressed in the trust instrument), statute, or equity. A person is legally constituted a trustee who (1) is originally designated as such by the instrument creating the trust, or is duly appointed as such under a power for the purpose contained in that instrument or under a statutory power for the purpose or by a court of competent jurisdiction or under a legally established scheme; and (2) accepts the trust either expressly or by acting in the execution of it. A person may also be constituted a trustee by statute, in which case acceptance of the trust is not essential unless required by statute. A person who is not legally constituted trustee becomes in equity a constructive trustee: (a) where, for want of a legally constituted trustee, trust property becomes in law vested in him; or (b) where he has acquired trust property in circumstances which in equity are deemed to require him to hold it upon the trust to which it was subject when he acquired it; or (c) where he intermeddles with and acts as trustee in relation to trust property, in which case he is also called a trustee de son tort. The number of trustees shall not in any case exceed four, and where more than four persons are named as such trustees, the four first named (who are able and willing to act) shall alone be the trustees, and the other persons named shall not be trustees unless appointed on the occurrence of a vacancy: Trustee Ordinance (Cap 29) s 36(2)(a). However, these restrictions do not apply in the case of land vested in trustees for charitable, ecclesiastical, or public purposes or where the net proceeds of the sale of the property are held for like purposes: s 36(3).
