释义 | 名譽領事 A resident citizen of a host state who administers the daily functions of a consulate together with his or her own private business. Except in relation to arrest and detention, an honorary consul enjoys the same freedom of communication and movement, and the same degree of judicial immunity as a career consul. There is an exemption from income tax on official remuneration, and some listed official goods are not subject to custom duties. Honorary consular archives, if maintained separately from other papers, are inviolable. The Vienna Convention on Consular Relations 1963 applies to the Hong Kong SAR and prevails over the Regulations of the People’s Republic of China concerning Consular Privileges and Immunities (which provides that appointments of consular officers from amongst persons of Chinese or third-state nationality or nationals of the sending state with permanent residence in the People’s Republic of China require the consent of the competent authorities of the People’s Republic of China). The latter is a national law applicable to the Hong Kong SAR by virtue of its inclusion in Annex III of the Basic Law and promulgation under Promulgation of National Laws (No 2) 1997 (LN 386/1997). Families of honorary consuls enjoy no privileges and their premises are not inviolable: Vienna Convention on Consular Relations 1963 art 5.
